Learner & Driving Instructor Terms and Conditions

1. Condition of Use:
   1. Following terms and conditions apply to your use of YourLocalDrivingInstructor.co.uk (or “we”) website and official portal.
   2. Before further participating in use of this website, you are advised to review these terms and conditions, since you will bound by them as well.
   3. Your use of this website and portal will be governed by these terms and conditions and any other additional terms that are incremented in the future.
   4. Your continuation of use of this web site and portal indicates your consent to these terms and conditions.
   5. By agreeing to these terms and conditions, you consent to communication to YourLocalDrivingInstructor.co.uk, and agree to your use of your information.
   6. Your provided information will be used by the laws stated in the Privacy Policy.
   7. YourLocalDrivingInstructor.co.uk must only be used for the purpose that it serves, the Learner Driver/Driving Instructor must not corrupt or fabricate any information ON this web site.
   8. The Leaner/Instructor will not provide any false information and will not try to trick the system by giving false information or feedback.
   9. The Learner Driver will be at all times responsible of the confidentiality of their login and credit card details on the portal, YourLocalDrivingInstructor.co.uk will not be accountable in case of any disruption regarding these details.
2. Learner Driver’s Use of the YourLocalDrivingInstructor.co.uk web site:
   1. The Learner Driver agree to:
      1. To use their own username and password and not borrow from anyone else; and
      2. To not share their login details with someone else; and
      3. Only use YourLocalDrivingInstructor.co.uk for the purpose that it serves and agree that:
         1. YourLocalDrivingInstructor.co.uk acts as third party in providing Learner Drivers with Driving Instructors; and
         2. YourLocalDrivingInstructor.co.uk is not responsible for any false information provided by the Driving Instructor and therefore will not be held accountable in case of any harm or conflict that might arise between the Learner Driver and the Driving Instructor. 
      4. That the information provided is true; and
      5. The Learner Driver will amend the details as soon as the change occurs.
   2. Along with all the terms regarding personal information, the Learner Driver also agrees that they:
      1. Will not use YourLocalDrivingInstructor.co.uk to spread hateful content; and
      2. Not use YourLocalDrivingInstructor.co.uk to gain access to information of other users and potentially harm them; and
      3. Not use this web site as means to promote third party or for commercial uses.
3. Term of Agreement:
   1. This agreement begins right when the Learner Driver agrees and continues to use this web site, and ends when the Leaner Driver terminates their use of the web site.
4. The Services Provided by YourLocalDrivingInstructor.co.uk:
   1. The Learner Driver agrees that they may use the YourLocalDrivingInstructor.co.uk web site to browse through the Driving Instructors and compare and choose the one they prefer.
   2. The Learner Driver can select their preference based on:
      1. Experience of the Driving Instructor; and
      2. Vehicle details; and
      3. Price; and
      4. Location; and
      5. Peer reviews.
   3. YourLocalDrivingInstructor.co.uk may match or recommend a Driving Instructor based on the preferences of the Learner Driver.
   4. YourLocalDrivingInstructor.co.uk may alter or increment services on the web site from time to time.
5. Parties:
   1. This agreement is between YourLocalDrivingInstructor.co.uk and the Learner Driver, and therefore governs terms in regards to this relationship; and
   2. This agreement is also between YourLocalDrivingInstructor.co.uk and Driving Instructor, and therefore governs terms in regards to this relationship as well.
6. Relationship of the Parties Involved:
   1. The Learner Driver consents and acknowledges:
      1. They are directly communicating with the Driving Instructor that acts as an independent contractor.
      2. The web site i.e. YourLocalDrivingInstructor.co.uk serves as a bridge in connecting the Learner Driver and the Driving Instructor.
      3. Any agreement that takes place amongst the Learner Driver and the Driving Instructor is solely amongst them and YourLocalDrivingInstructor.co.uk will not be included as a party.
      4. The Driving Instructor is an independent contractor and therefore is not an employee or agent of YourLocalDrivingInstructor.co.uk, and YourLocalDrivingInstructor.co.uk would not be liable or responsible for any misconduct by the Driving Instructor.
      5. YourLocalDrivingInstructor.co.uk does not itself investigate or carry out a due diligence on the Driving Instructor and therefore, YourLocalDrivingInstructor.co.uk is not liable for any loss, harm or claim that occurs as a result of booking a certain Driving Instructor.
   2. Payment Terms:
      1. The Learner driver agrees that they are immediately liable to pay for driving lessons after they have booked a particular Driving Instructor.
      2. When the Leaner Driver enters their credit card details using Paypal, they are authorized to make transactions through the card.
      3. YourLocalDrivingInstructor.co.uk can refuse a payment if it believes that the credit/debit card holder did not authorize the transaction using Paypal facility; if the transaction is considered fraudulent and/or by any conditions that seem to bother YourLocalDrivingInstructor.co.uk under its discretion.  
7. Refunds:
   1. In an event that the Learner Driver wishes to cancel their booking, it is advised for them to report this change 48 hours before the start of the lesson. During this time, if the payment has been made, YourLocalDrivingInstructor.co.uk can provide a full refund of the payment. However if the time has elapsed, YourLocalDrivingInstructor.co.uk will not entertain any claims of refund.
8. Payments and Costs:
   1. The Learner Driver agrees that the lessons costs might change from time to time.
   2. The cost of lesson is determined by the independent Driving Instructor, therefore YourLocalDrivingInstructor.co.uk will not be held accountable for a change in the cost.
   3. The Learner Driver will be paying the cost directly to YourLocalDrivingInstructor.co.uk, which will in return take their 10% share of the cost and deliver the rest to the Driving Instructor.
   4. In an event that the Driving Instructor wishes to change the cost of a lesson, the Learner Driver will be notified.
9. Lesson Cancelation by Learner Driver:
   1. In an event that the Learner wishes to cancel a lesson that they have already paid the cost of, refer to clause 7.
10. Lesson Cancelation by the Driving Instructor:
    1. If the Driving Instructor cancels a lesson, YourLocalDrivingInstructor.co.uk will provide the Learner Driver with a notice to inform of this cancelation and attempt to provide a replacement driving Instructor.
    2. However if the replacement Driving Instructor is not found, YourLocalDrivingInstructor.co.uk will issue a refund of that payment.
11. Tax Compliance:
    1. The Learner Driver agrees to pay any relevant applicable tax on the transactions to the YourLocalDrivingInstructor.co.uk.
12. Events of Termination:
    1. The Learner Driver agrees that the YourLocalDrivingInstructor.co.uk can terminate their access to the web site with given prior notice if they:
       1. The Leaner Driver breaches any term in this agreement; and
       2. Have broken the law and is charged with criminal offense; and
       3. Are no longer permitted by the law to drive; and
       4. Have not accessed their portal in a long time (preferably six months or longer); and
       5. In any other circumstance that seems unfitting to YourLocalDrivingInstructor.co.uk.
    2. The Learner Driver can terminate their use of this web site if they:
       1. No longer garner any purpose from this site; and
       2. Have completed their course of lessons; and
       3. Wish to halt or end their progress on this site; and
       4. Wish to register a new account and discard the current account.
13. Privacy:
    1. The Learner Driver and the Driving Instructor agree to adhere to the Privacy Policy of YourLocalDrivingInstructor.co.uk.
    2. Learner Driver agrees that the YourLocalDrivingInstructor.co.uk will collect their information and use it for marketing purposes and providing services as stated in the Privacy Policy.
    3. Learner Driver agrees that the YourLocalDrivingInstructor.co.uk will collect their name, gender, age, and location, financial and contact information.
    4. Learner Driver agrees that they can access their information presented to the YourLocalDrivingInstructor.co.uk by requesting through email.
    5. The Learner acknowledges and agrees to all the terms in the Privacy Policy, including all the alterations from time to time.
14. Indemnity:
    1. The Learner Driver agree to compensate and protect YourLocalDrivingInstructor.co.uk in an event of damage and harm against the YourLocalDrivingInstructor.co.uk which are a result of any action taken by the Learner Driver.
15. Intellectual Property:
    1. The Learner Driver agrees that the content on the YourLocalDrivingInstructor.co.uk web site is their intellectual property and any alteration and distortion of this content is strictly prohibited.
16. Fidelity:
    1. The Learner driver agrees to not indulge in any activity that harms YourLocalDrivingInstructor.co.uk or the reputation of YourLocalDrivingInstructor.co.uk.
17. Complaints Procedure:
    1. YourLocalDrivingInstructor.co.uk takes customer complaints seriously and encourages its users to send an email in case of any complaints. We will respond and investigate the complaint in reasonable amount of time.
18. Promotions by third parties
    1. The Learner Driver agrees that YourLocalDrivingInstructor.co.uk may issue reward cards, gift cards, vouchers or promotional cards in connection with third party offers or services to Learner Drivers from time to time, at the sole discretion of YourLocalDrivingInstructor.co.uk.
    2.  It is the sole responsibility of the Learner Driver to read and understand the relevant terms and conditions of the provider.
19. Policies
    1. The Learner Driver warrants that they have read and understood the following documents:
       1. the YourLocalDrivingInstructor.co.uk Payment Policy;
       2. the YourLocalDrivingInstructor.co.uk Privacy Policy; and
20. Learner Driver Agreement:
    1. The Learner Driver agrees that they have read all the terms and conditions of the web site, and are willing to be bound by these terms on the continuation of the use of this web site.
